US Judge Mandates Release of Abrego Garcia from ICE Detention

A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment lacks legal authority.

"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her order.

The situation originates in a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. After his repatriation to the United States to answer human smuggling allegations, he was held in immigration detention.

In her order, the court pointed out that the authorities does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."

The court proceedings involve disputed claims. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.

He has also entered a not guilty plea to the smuggling charges, which are part of a separate trial in Tennessee.
